The terms of this privacy policy (“Privacy Policy”) apply to personal data that we collect from you as a user of this Site or as a Membership applicant, Member, or customer (“you” or “your” being interpreted accordingly). It provides information on what personal data (“Personal Data”) we collect, why we collect the Personal Data, how it is used, and the lawful basis on which your Personal Data is processed. This Privacy Policy applies to any information collected, including but not limited to information collected on the Club’s website, www.vitabrevis.club, (“Site”).

1. INFORMATION COLLECTED:  This Privacy Policy applies to the minimum amount of Personal Data that we collect from you as a Membership applicant, user of this Site, or as a Member. Such Personal Data collection is limited to your name, address, telephone number, and email address. The California Consumer Privacy Act (“CCPA”) defines your PAs a Member, we may also collect the names of your guests. For purposes of the Site and Membership Application, your credit card or payment information is not stored on our servers and is processed separately by a PCCI compliant third-party processor.  All other Personal Data mentioned in this section is stored on encryption enabled secure servers. We may arrange such credit card or payment information submitted in support of your Membership application or Fees related to the Club or Membership if your initial application is successful (or if you are put on to a Membership waiting list, please note that this Personal Data may be stored for later use to initiate Membership. We store and use this card or payment information for the purpose of processing any future payments that you make as a Member for additional goods and services. We will store this data in accordance with our legal obligations under applicable law and only for so long as legally permitted. Should you choose to opt out of us holding your card or payment information, you may need to re-supply us with such details to re-initiate Membership or for the purpose of making any future purchases. Your Membership application and/or Personal Data is only visible to the Club and Management. At no time, will the Club or Management sell your Personal Data to any third party without your prior written consent or legal opt in; we do not sell Personal Data. At any time, you may request a copy of your Personal Data being used for the Club’s Membership. You may further make deletion requests from our systems by emailing us at membership@vitabrevis.club. We will only use your Personal Data to process your Membership application, to process your authorized requests, and to communicate with you as needed from time to time. You have the right to opt out and unsubscribe from any email communications related to Club gatherings and events, or by contacting us at membership@vitabrevis.club to be deleted from such relevant mailing lists. If you request to delete your data or to be removed from our marketing lists and we are required to fulfil your request, to keep basic data to identify you and prevent further unwanted processing. Our Site uses cookies (small text files placed on your device) and similar technologies to distinguish you from other Members. This is to provide you with a good online Membership experience when you browse our Site and allows us to improve its features. For any questions or preferences on cookie opt-outs, please contact us. You may have further rights in addition to this section that the Club and Management will comply with, effective January 1, 2020, in accordance with the California Consumer Privacy Act. 

2. DISCLOSURE OF YOUR INFORMATION:  We may disclose your Personal Data (i) to comply with a legal obligation and/or judicial or regulatory proceedings, a court order or other legal process; (ii) to enforce our Terms, Club Rules, or other applicable contract terms that you are subject to or (iii) to protect us, our Members, Membership applicants, or Management against loss or damage. This may include (without limit) exchanging information with the police, courts, or law enforcement organizations.

3. CHANGES: We reserve the right to modify or change this Privacy Policy at any time and from time to time, so please review it frequently. Modifications or changes will take effect immediately upon their posting on the website. If we make material changes to this Privacy Policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
